Return / withdrawal

There are times when you may wish to return an order. Whatever the reason, you have the right to cancel your order up to 14 days after receipt without giving a reason.

You have another 14 days after cancellation to return your product.

To register a return or cancellation, please email info@esquell.nl.

Please provide the following in the mail:

• Order number, order date, item type and item number.
• Name and phone number
• If it is a complaint, the reason for the complaint.
• If you want to use the right of withdrawal, it is not obligatory to provide a reason. However, we do appreciate this. With your information we can improve our offer and services.

After registering the return you will receive a refund within 14 days. If you return the entire order, your shipping costs for sending your order to you will also be returned if they were applicable to your order. We wait with the return payment until we have received the item / items back.

Return shipping costs from your home to our online store are at your own expense. For exact return shipping rates, please consult your carrier’s website.

If you exercise your right of withdrawal, the product will be returned to Esquell with all delivered accessories and – if reasonably possible – in its original condition and packaging.

Should the product and / or packaging be more damaged than necessary to try the product or parts are missing, we may pass this depreciation of the product on to you. So please treat the product with care and make sure it is properly packaged when returning it.

Items made especially for you, and cut off items or utility items already used by you cannot be returned.

This right of withdrawal is a right which applies exclusively to consumers. If items are purchased in company name, we reserve the right to refuse returns or make other arrangements. Shipping costs for return shipping are not refundable.

Article 6 – Right of withdrawal

On delivery of products:

1. When purchasing products, the consumer has the option of dissolving the agreement without giving reasons for 14 days. This reflection period starts on the day after receipt of the product by the consumer or a representative previously designated by the consumer and made known to the entrepreneur.
2. During the reflection period, the consumer will handle the product and its packaging with care. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If he exercises his right of withdrawal, he will return the product with all accessories supplied and – if reasonably possible – in the original condition and packaging to the entrepreneur, in accordance with the reasonable and clear instructions provided by the entrepreneur.
3. When the consumer wishes to use his right of withdrawal, he is obliged to make this known to the entrepreneur within 14 days after receipt of the product. The consumer must make this known using the model form. After the consumer has made it known that he wants to use his right of withdrawal, the customer must return the product within 14 days. The consumer must prove that the delivered goods have been returned in time, for example by means of a proof of shipment.
4. If the customer has not made known after the expiration of the periods mentioned in paragraphs 2 and 3 that he wishes to exercise his right of withdrawal or has not returned the product to the entrepreneur, the purchase is a fact.

When providing services:

1. With the delivery of services, the consumer has the option of dissolving the agreement without giving reasons for at least 14 days, starting from the day of entering into the agreement.
2. To make use of his right of withdrawal, the consumer will comply with the reasonable and clear instruction provided by the entrepreneur in the offer and/or at the latest at the time of delivery.
3. Article 7 – Costs in case of withdrawal
   1. If the consumer exercises his right of withdrawal, at most the cost of return shipment shall be borne by him.
   2. If the consumer has paid an amount, the entrepreneur will refund this amount as soon as possible, but no later than 14 days after revocation. This is subject to the condition that the product has already been received back by the merchant or conclusive evidence of complete return can be provided.

Article 8 – Exclusion of the right of withdrawal.

1. The entrepreneur can exclude the consumer’s right of withdrawal for products as described in paragraphs 2 and 3. The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, at least in time for the conclusion of the contract.
2. Exclusion of the right of withdrawal is only possible for products
   a. that have been created by the entrepreneur in accordance with consumer specifications;
   b. that are clearly personal in nature;
   c. which by their nature cannot be returned;
   d. that may spoil or age quickly;
   e. whose price is subject to fluctuations in the financial market over which the entrepreneur has no influence;
   f. for single newspapers and magazines;
   g. for audio and video recordings and computer software of which the consumer has broken the seal.
   h. for hygienic products whose seal has been broken by the consumer.
   3. Exclusion of the right of withdrawal is only possible for services:
   a. concerning lodging, transportation, restaurant business or leisure activities to be performed on a specific date or during a specific period;
   b. whose delivery began with the consumer’s express consent before the cooling-off period expired;
   c. concerning betting and lotteries.
